1 - Scope

The terms and conditions acknowledge the business relationship between MERTOR INVEST, S.L. (from now on, Vesmer or the Company), a Spanish commercial entity, with tax residence in C/ Entença 332-334, 4º 4ª - 08029 Barcelona (Spain), and ID no. B-65714693, registered in the Barcelona Companies Registry, volume 42972, sheet 81, page B-416762 and the Customer, relating all transactions made on the website www.vesmer.es (from now on, “Online shop”).

2 - Definitions

"Contract documents of the site".- These include Terms and Conditions, Delivery Policy, Returns and cancellations policy. Any other contract, agreement, notice or Policy that the Company may issue on occasion and that may apply to the online shop will be also included in these documents.

"Online Catalog of products" or "Catalog".- The catalog includes all the goods services available on our Online Shop; these items might not be available or in stock when the order is placed; the Company may change, replace or discontinue items and products on occasion. 

“Purchase order” or “Order”.- Is a data message generated by the costumer, in which a list of the products including quantity and price, accepting on the terms and conditions previously established. 

“Order confirmation”.- Is the data message generated by the Online shop in which accepts the order placed by the costumer. This message is a confirmation of the trade and specifies the time and date of the purchase. It also includes the Order number so that the customer can monitor the delivery status of their purchase.  

3 - Purchase Order Acceptance 

Products are purchased by clicking the “BUY NOW” button on the purchase form, and it implies the acceptance of the terms and conditions listed on this website. Any update on the Terms and conditions section will not be applied after the acceptance of the current purchase.  

From that moment on, the user becomes a company customer as described in the present document of terms and conditions. Any other product or service offered by Vesmer will be included in a different contract. 

The custumer can print or save the document of Terms and conditions for future reference.  

Once the Terms and conditions are accepted, Vesmer will send proof of the transaction via e-mail during the next 24 hours.

Vesmer files all the purchases in electronic format.  

If there is any mistake detected in the data, the customer can change it in the "My Account" section and it will be taken into account for future reference or purchases. If there is a mistake in the current order, the customer will have to contact Vesmer as soon as possible. 

4 - Shipping information

There are different shipping options depending on the items purchased on our online shop. When you are ready to accept the order, we will ask you to choose a shipping method. The shipping costs are based on the method chosen and they are calculated automatically, before finalizing the purchase. 

a.- Deliveries and methods

Vesmer sends orders all over the world, except post office boxes.

For our orders in Spain and Portugal (mainland) our chosen distribution company will be Nacex. For European and international orders the logistics company will be FEDEX (these partners guarantee the delivery periods explained in the following section).

You will receive the order within one business day (19-24 hours). We consider a business day from Monday to Friday, except holidays marked on the official calendar. The price of the shipment is € 4.99. This shipping method is free for purchases above € 500 (taxes not included).

· Spain - Balearic Islands (Delivery on the next business day, within 19-24 hours)

You will receive the order within one business day (19-24 hours). We consider a business day from Monday to Friday, except  holidays marked on the official calendar. 

The price of the shipment is € 8.90, this shipping method is free for purchases above 500 EUR (taxes not included).

· Portugal mainland (Delivery on the next business day, within 19-24 hours)

You will receive the order within one business day (19-24 hours). We consider a business day from Monday to Friday, except  holidays marked on the official calendar. 

The price of the shipment is € 5.50, this shipping method is free for purchases above € 500 (taxes not included).

· Canarias, Ceuta, Melilla, Andorra, Europa and Rest of the World (Delivery to be confirmed)

5 - Order tracking and history

You can track your orders at “order history and details” section in “My Account”. You will find there your previous orders and the status of your current order.

6 - Revision of products

Bear in mind that you assume the risk of the products once the delivery is completed. If the package is damaged, please, do not accept the delivery. You have the right to inspect the product and notify any complaint. In the case of receiving any defective item or in disagreement with your request, you have a maximum of 2 days to notify us, by sending an e-mail to info@vesmer.es explaining the return reasons. 

7 - Availability and Validity of the offer

We strive to ensure that all of the items offered on our website are in stock. In the event of someone asking for items that are not in stock, we reserve our right to not accept the order. You will be informed by e-mail and any other payment will be refunded.

The prices and promotions that appear on our website are valid at the moment that the order takes place, unless other terms are otherwise stated. Errors may occur in the prices or there can be spelling mistakes.

8 - Orders

The Online Shop is open 24/7. Nevertheless, the shop can be closed due to maintenance. For your convenience, we try to run these changes at night.

To purchase on www.vesmer.es you must be over 18 and be a professional in the jewelry sector, trade, street vending...

We can decline an offer or cancel a purchase in any of the situations stated below, without being responsible for any cost or damage. We will notify you by email before any action:

  •  our tax information is incorrect or not verifiable.
  •  your order may be made for fraudulent purposes or in connection with a criminal offense or another illegal activity.
  •  an involuntary error has occurred on the online shop
  •  if we have reasons to believe that you may be underage or not a professional in the jewelry sector.

When you place an order on our Online Shop, you make a purchase offer of the items selected with these terms and conditions. We can accept or not the offer at our discretion.

We will only accept offers that are made through our website, by phone or through our sales department. We cannot accept orders made by e-mail, letter or fax.

9 - Formalization of the purchase

The purchase is formalized when you click on the “BUY NOW” button, and once the receipt appears on the screen, you commit to making the purchase. However, please, check the “Returns” section.

The receipt shown on your screen is an automatic data message indicating that we have received your purchase offer. Nevertheless, this recognition does not mean that we have accepted the offer. Vesmer reserves the right to decline your offer after the automatic receive is generated, and in this case, you will be duly informed.

If you made a mistake placing the order, please contact or Customer Service, we will be pleased to help you. All the same, please, always make sure to revise your order before placing it.

 10 - Policy of changes, returns and withdrawals

As Wholesale supplier, no changes or returns will be accepted unless the pieces sent are defective or a wrong product has been received.

• All products that are going to be exchanged or returned must be properly packaged, under the same conditions in which they were sent and with their original label (in the case that they have it).

• Vesmer will not accept shipments with unpaid postage.

11 - Fraud Check

In order to protect our customers and maintain the security of buying online, we can check the data they provide when placing an order. These controls may include verification of address and payment method.

Only payment in euros is accepted.

13 - Prices and Taxes

All product prices, shipping prices and other services do NOT include VAT. Shipping costs are added per order. We will always inform you of the total price, including all taxes and other costs such as fees and possible delivery costs.

The prices that appear on the website are those that apply at the time of purchase. Prices may be subject to change without notice, but the changes will not affect the orders we have already accepted.

14 - Secure Purchase

Vesmer is committed to protecting the personal information of our customers. We use the industry standard encryption protocol to keep your order information secure. All orders are transmitted in an encoded format. To make sure your request is secure, simply check it in your Internet browser while in the order section. Most browsers use some type of symbol to alert you to the fact that you are on a secure website. We keep your shipping and billing information when creating an account with us, but that information will not be used by anyone other than Vesmer and third parties who provide services related to www.vesmer.es.

15 - Minors

Our site is not aimed at children under 18 years of age. We do not knowingly collect or store information about minors. If we are informed that a minor has made a purchase without the consent of his father, mother or legal guardian, we immediately, upon request of the parents, proceed to cancel the sale.

16 - Photographs

Some items may appear a little larger or smaller than their actual size due to the screen settings and photographic technique. Other items may be represented in a size larger than their actual size in order to clearly show the details, or smaller than their actual size, in order to display the entire article. Also the color tones in the photographs of the products of the Online Store may be altered by the resolution of your monitor and may differ from the real ones.

17 - Jewelry Care

Most of the items on the website are made of precious metals such as Sterling Silver, all our items in this metal are of excellent quality (925 Silver). Whenever an item is not of this metal, the buyer can identify it quickly as Vesmer will detail it in the product specifications. This type of material needs special care for its perfect conservation, here are some tips and warnings:

-The silver oxidizes in contact with the air and this causes that its hue tends to blacken or turn yellow. The silver pieces can be cleaned with a special suede so that they regain their shine or with water and neutral soap.

-Avoid storing pieces together so they don't get scratched. Try to keep them away from any exposure to sunlight and away from warm places.

* IMPORTANT: The gold-plated silver pieces are more delicate and require greater care, rubbing them intensely can lead to loss of the bath, so it is important to do it subtly to avoid bath wear. Vesmer does not guarantee that the gold plating of our models will last forever. Gold-plated pieces are, by default, more fragile and likely to lose color with use and the passage of time. The speed at which this color disappears depends on multiple factors such as the use of chemicals in the skin, the level of body sweating or even the same level of PH of the skin of each person. For this reason, it is especially important to take proper care of gold-plated jewelry.

19 - Languages

The languages in which the contract between Vesmer and the Client will be perfected are Spanish, Catalan, English or Portuguese.

20 - Customer Responsibilities

The Costumer undertakes to make a lawful use of the Services, without exceeding the current legislation, nor injuring the rights and interests of third parties.

The Costumer guarantees the veracity and accuracy of the data provided by filling in the contracting forms, avoiding the cause of damage to the company.

A failure to comply with any of these terms and conditions may result in the withdrawal or cancellation of the Services by Vesmer without prior notice to the Costumer and without giving any right to compensation.

21 - Personal details and commercial communications

For the purposes of the Organic Law 15/1999, of December 13, on the Protection of Personal Data, we inform you that your personal data will be part of a file owned by MERTOR INVEST, SL, in order to manage your order, answer your questions and send you information about the Vesmer brand products and services, both by postal and electronic means.

Likewise, your data may be communicated to other companies or brands related to MERTOR INVEST, SL, unless you object to it using the means indicated below, in order to be informed about the products and services they sell, by any means including electronic.

You can exercise the rights of access, rectification, cancellation and opposition, as well as revoke the consent given for the sending of commercial communications, by writing to our facilities: MERTOR INVEST, S.L., C /. Entença no. 332-334, 4-4, 08029 of Barcelona, ​​Spain, indicating the reference "Data protection" or sending an e-mail to info@vesmer.es, indicating your name and providing a copy of your ID or equivalent identification document.

22 - Industrial and Intellectual Property

The intellectual and industrial property rights over the products, photographs, brands, logos, and any other subject to protection, contained in the Vesmer website correspond exclusively to Vesmer or to third parties that have authorized their inclusion in the website. The unauthorized reproduction, distribution, commercialization or transformation of such works, brands, logos, photographs, etc. constitute an infringement of the intellectual and industrial property rights of Vesmer or the owner thereof, and may result in the exercise of any judicial or extrajudicial actions according to their rights.

Likewise, the information to which the Costumer can have access to the website, may be protected by industrial, intellectual or other property rights. Vesmer will not be liable in any case and under any circumstances for infringements of such rights commited by the user.

23 - Jurisdiction and applicable Law

The relationship between Vesmer and the Customer will be governed by current Spanish regulations and any dispute will be submitted to the corresponding Courts and Tribunals.

The Company will pursue the breach of these Terms and Conditions as well as any improper use of the website by exercising all civil and criminal actions that may correspond and assist in law.
