1) Subject matter and scope

These terms and conditions aim to regulate the relationship between MERTOR INVEST, S.L. (henceforth VESMER or the company), Spanish commercial entity, with tax residence in C/ Entenza nº 332-334, 4º 4ª - 08029 Barcelona (España), and N.I.F. Nº B-65714693, in the Barcelona Companies Registry, volume 42972, sheet 81, page B-416762 and you (henceforth the costumer), relating all transactions made on our website  www.vesmer.es (henceforth “Online shop”).

2) Definitions

"Contractual documents of the site".- The term includes Terms and Conditions, Delivery Policy, Returns and cancelations. The term also includes any other contract, agreement, notice or Policy that the Company Issue and publish from time to time and that applies to the transactions made through our Online Shop. 

"Online Catalog of products" or "Catalog".- Is formed by all the goods, and in its case, services, that you can find available on our Online Shop; the catalog items are not necessarily available or in stock when the order is placed; therefore they can be changed, replaced or discontinued from time to time at the discretion of the company. 

“Purchase order” or “Order”.- It is the data message that is generated by the customer to request the purchase of a product and in which the customer manifests the will of acquiring the product in the quantity, price and terms and conditions established there. 

“Order confirmation”.- Is the data message generated by the Online shop in which the company manifests the approval to fulfill the order demanded by the customer. The Order confirmation confirms that the company has sold and the customer has purchased the corresponding items and clarifies the time of purchase. The message includes the order number so the customer can monitor the delivery status.

3) Acceptance of the Order

The acquisition of the products has to be made through the button “BUY NOW” on the footer on the purchase request, and it expresses the total acceptance of all the terms and conditions, as they are shown on the Vesmer website before the purchase of these products, without being applied the updates in the clauses of terms and conditions hereinafter. 

From the moment of acceptance, the user acquires the condition of Company Costumer that is described in these terms and conditions. Any product or service offered thereupon by Vesmer will have to subject of a different contract. 

If the customer wishes to read and further examine the terms and conditions, they can print them on paper or save the document in electronic format. 

Vesmer will remit the customer once they accept explicitly these terms and conditions, the justification for the recruitment completed, with its terms, through email, before the next 24 hours. Vesmer informs you that they file the electronic documents in which the purchases are spelled out. 

In case of the customer making a mistake then sending the data, they will be able to change them in the section “My Account” and it will be borne in mind in future acquisitions. In the event of the mistake being in the current order, the customer will have to contact Vesmer as soon as possible.

4) Shipping information.

Depending on the item or items purchased through the online shop, you have different shipping options. When you are ready to accept the order, we will ask you to choose a shipping method for your purchase. The shipping costs are based on the shipping method chosen and they are calculated automatically, before finalizing the order.

Currently, we send orders all over the world, except for a post office box.

For our orders in Spain and Portugal (Peninsula9) our chosen distribution company will be Nacex. For European and international orders the logistics company will be FEDEX (these partners guarantee the delivery times explained in the following section).

You will receive the order within one business day (19-24 hours). We consider a business day from Monday to Friday, except official holidays marked on the official calendar. The price of the shipment is 4,99 EUR, this shipping method is free for purchases above 500 EUR (taxes excluded).

· España - Baleares (Delivery on the next business day "19-24 hours")

You will receive the order within one business day (19-24 hours). We consider a business day from Monday to Friday, except official holidays marked on the official calendar. 

The price of the shipment is 8,90 EUR, this shipping method is free for purchases above 500 EUR (taxes excluded).

· Portugal Península (Delivery on the next business day "19-24 hours")

You will receive the order within one business day (19-24 hours). We consider a business day from Monday to Friday, except official holidays marked on the official calendar. 

The price of the shipment is 5,50 EUR, this shipping method is free for purchases above 500 EUR (taxes excluded).

· Canarias, Ceuta, Melilla, Andorra, Europa and Rest of the World (Delivery "to be confirmed")

5) order tracking and history

You can track your orders at “order history and details” in “My Account”. There you will find your previous orders and the status of your current order,

6) Review of products

Bear in mind that you assume the risk of the products once the delivery is completed. If the package is damaged, please, do not accept the delivery. Without prejudice to your rights, you are responsible inspect the product and notify any complaint. In the case of receiving any defective item or in disagreement with your request, you have a maximum of 2 days to notify us, by sending an email to info@vesmer.es explaining the return reasons. 

7) Availability and Validity of the offer

We strive to have stock of all the items offered on our website. In the case of someone asking for items that are not in stock, we reserve our right to not accept the offer. You will be informed by email and any other payment will be, naturally, restored.
The prices and promotions that appear on our website are valid at the moment that they occur unless other specific terms otherwise stated. Errors may occur in the prices or there can be spelling mistakes.

8) Orders

The Online Shop is open 24/7. Nevertheless, the shop can be closed due to maintenance. For your convenience, we try to run these changes at night.
To purchase on www.vesmer.es you must be over 18 and be a professional from the jewelry sector, trade, street vending...
We can decline an offer or cancel a purchase in any of the next situations, without being responsible for any cost or damage. We will notify you by email before any action:
 -Your tax information is incorrect or not verifiable.
 -Your order may be made for fraudulent purposes or in connection with a criminal offense or another illegal activity.
 -An involuntary error has occurred on the online shop
 -If we have reasons to believe that you may be underage or not a professional in the jewelry sector.
When you place an order on our Online Shop, you make a purchase offer of the items selected in these terms and conditions. We can accept or not the offer at our discretion.
We will only accept offers that are made through or website, by phone or through our sales department. We cannot accept orders made by email, letters or fax.

9) Formalization of the purchase

The purchase is formalized then you click “Buy NOW” and after the receipt is shown on the screen, you commit to making the purchase. However, please, refer to the section “Returns”.
The receipt shown on your screen is an automated recognition and it means that we have received your purchase offer. Nevertheless, this recognition does not mean that we have accepted the offer, we reserve our right to decline your offer after we have received the automated recognition, and in this case, you will be duly notified.
If you made a mistake placing the order, please contact or Customer Service that will be pleased to help you. All the same, please, always make sure to revise your offer before placing the order.

 

10) Policy of changes, returns and withdrawals

Being wholesale sales no changes or returns are accepted unless the piece/s sent is/are defective or a mistaken product has been received.

• All products that are going to be exchanged or returned must be properly packaged, under the same conditions in which they were sent and with their original label (in the case that they have it).

• Vesmer will not accept shipments with unpaid postage.

11) Fraud Check

In order to protect our customers and maintain the security of buying online, we can check the data they provide when sending an order. These controls may include verification of address and payment method to prevent fraud.

13) Prices and Taxes

All product prices, shipping prices and other services do NOT include VAT. Shipping costs are added per order. We will always inform you of the total price, including all taxes and other costs such as fees and possible delivery costs.

The prices that appear on the website are those that apply at the time of purchase. Prices may be subject to change without notice, but the changes will not affect the orders we have accepted.

14) Secure Purchase

Vesmer is committed to protecting the personal information of our customers. We use the industry standard encryption protocol to keep your order information secure. All orders are transmitted in an encoded format. To make sure your request is secure, simply check it in your Internet browser while in the order section. Most browsers use some type of symbol to alert you to the fact that you are on a secure website. We keep your shipping and billing information when creating an account with us, but that information will not be used by anyone other than Vesmer and third parties who provide services related to www.vesmer.es.

15) Minors

Our site is not aimed at children under 18 years of age. We do not knowingly collect or store information about minors. If we are informed that a minor has made a purchase without the consent of his father, mother or legal guardian, we immediately, upon request of the parents, proceed to cancel the sale.

16) Photographs

Some items may appear a little larger or smaller than their actual size due to the screen settings and photographic technique. Other items may be represented in a size larger than their actual size in order to clearly show the details, or smaller than their actual size, in order to display the entire article. Also the color tones in the photographs of the products of the Online Store may be altered by the resolution of your monitor and may differ from the real ones.

17) Jewelry Care

Most of the items on the website are made of precious metals such as Sterling Silver, all our items in this metal are of excellent quality (925 Silver). Whenever an item is not of this metal, the buyer can identify it quickly as Vesmer will detail it in the product specifications. This type of material needs special care for its perfect conservation, here are some tips and warnings:

-The silver oxidizes in contact with the air and this causes that its hue tends to blacken or turn yellow. The silver pieces can be cleaned with a special suede so that they regain their shine or with water and neutral soap.

-Avoid storing pieces together so they don't get scratched. Try to keep them away from any exposure to sunlight and away from warm places.

* IMPORTANT: The gold-plated silver pieces are more delicate and require greater care, rubbing them intensely can lead to loss of the bath, so it is important to do it subtly to avoid bath wear. Vesmer does not guarantee that the gold plating of our models will last forever. Gold-plated pieces are, by default, more fragile and likely to lose color with use and the passage of time. The speed at which this color disappears depends on multiple factors such as the use of chemicals in the skin, the level of body sweating or even the same level of PH of the skin of each person. For this reason, it is especially important to take proper care of gold-plated jewelry.

19) Languages

The languages in which the contract between Vesmer and the Client will be perfected are Spanish, Catalan, English or Portuguese.

20) Customer Responsibilities

The Costumer undertakes to make a lawful use of the Services, without contravening the current legislation, nor injuring the rights and interests of third parties.

The Costumer guarantees the veracity and accuracy of the data provided by filling in the contracting forms, avoiding the cause of damage to Vesmer due to their incorrectness.

Failure to comply with any of these terms and conditions may result in the withdrawal or cancellation of the Services by Vesmer without prior notice to the Costumer and without giving any right to compensation.

21) Personal details and commercial communications

For the purposes of the Organic Law 15/1999, of December 13, on the Protection of Personal Data, we inform you that your personal data will be part of a file owned by MERTOR INVEST, SL, in order to manage your order, answer your questions and send you information about the Vesmer brand products and services, both by postal and electronic means.

Likewise, your data may be communicated to other companies / brands related to MERTOR INVEST, SL, unless you object to it using the means indicated below, in order to be informed about the products and services they sell, by any means including electronic.

You can exercise the rights of access, rectification, cancellation and opposition, as well as revoke the consent given for the sending of commercial communications, by writing to our facilities: MERTOR INVEST, S.L., C /. Entenza nº 332-334, 4-4, 08029 of Barcelona, ​​Spain, indicating Ref. "Data protection" or sending an email to the following address info@vesmer.es, indicating your name and providing a copy of your ID or equivalent identification document.

 

22) Industrial and Intellectual Property

The intellectual and industrial property rights over the products, photographs, brands, logos, and any other subject to protection, contained in the Vesmer website correspond exclusively to Vesmer or to third parties that have authorized their inclusion in the website. The unauthorized reproduction, distribution, commercialization or transformation of such works, brands, logos, photographs, etc. constitute an infringement of the intellectual and industrial property rights of Vesmer or the owner thereof, and may result in the exercise of any judicial or extrajudicial actions that may correspond to them in the exercise of their rights.

Likewise, the information to which the Costumer can have access to the website, may be protected by industrial, intellectual or other property rights. Vesmer will not be liable in any case and under any circumstances for infringements of such rights that you may commit as a user.

23) Jurisdiction and applicable Law

The relationship between Vesmer and the Costumer will be governed by current Spanish regulations and any dispute will be submitted to the corresponding Courts and Tribunals.

The Company will pursue the breach of these Terms and Conditions as well as any improper use of the website by exercising all civil and criminal actions that may correspond and assist in law.
